Ich glaube nicht, dass die sich die Mühe machen nachzuweisen, dass da tatsächlich ein Upload / eine Verbreitung stattgefunden hat. Es reicht vermutlich aus, wenn ein Torrent-Client verwendet wurde, bei dem dann von der „üblichen“ Funktionsweise ausgegangen wird. Ob es tatsächlich einen Upload gab oder nicht, wäre dann in der Gerichtsverhandlung zu klären, zu der es aber normalerweise nicht kommt.

Oder keine Torrents benutzen. Soweit ich weiß, ist nicht der Download das eigentliche Problem, sondern das gleichzeitige zur Verfügung stellen von heruntergeladenen Inhalten für andere (so funktionieren Torrents wohl), was dann als „Verbreitung von Raubkopien“ angesehen werden kann.
