TL;DR right-wing judges made this up to strike down presidential actions they don’t like. Conveniently, there’s no real test for what a major question is.

Re point #1, it seems like a lot of people think that Hamas is Palestinian resistance and Palestinian resistance is Hamas. That couldn’t be farther from the truth, but it’s only too convenient for Israel boosters that Hamas is the most visible. That didn’t used to be the case. There are a lot of groups and schools of thought that fall work towards Palestinian liberation.
